I am having copyright issue with your audio product on my YouTube channel. I have the license and after disputing the claim, you rejected the claim. You need to check and resolve that for me ASAP!
Is this your video? https://www.youtube.com/watch?v=cYW34USH-O4
If yes, it looks like a music mix with changes of the frames (footages, video effects). Recently I had a long dialogue with Envato’s support. And it was decided that the use of a music license in this form is unacceptable. When music is the basis of a compilation or mix and is the basis, with a change of frames, footages, effects – this is not allowed by the license and is not allowed to be used in this form.
And you have license from NO AudioJungle, if I know right, but Elements.
Yes, that is my video. I am not aware of this as Envato has not made users to know about this. My license with your audio is from Envato element. I will ask that you release this claim for this one time. I have taken note of the usage as you stated and will not use audio in a mix.
This is already specified in the license terms of use. Just read, please, point 11 in terms of use:
‘You can’t redistribute the Item as stock, in a tool or template, or with source files. You can’t do this with an Item either on its own or bundled with other items, and even if you modify the Item. You can’t redistribute or make available the Item as-is or with superficial modifications. These things are not allowed even if the redistribution is for free.’
This text from point 11 from here: https://elements.envato.com/license-termsI emphasize once again the words from this paragraph, which vividly characterize how you CANNOT use the license, but you are trying to do it:
‘You can’t redistribute or make available the Item as-is or with superficial modifications. These things are not allowed even if the redistribution is for free.’
And in your case, simply putting an image (footages, effects) up with the full song, unedited that isn’t larger in scope and different in nature than the Item, is not enough to satisfy the license requirements.
Can you cite clear example of how the item can be used.
You can use music as part of a project (where music and video are one, sometimes words are also added, the voice of the announcer). That is, when the meaning of the whole project is lost when one of the channels is turned off. In your case, if we turn off the visual series, the meaning remains, because the basis and essence of the whole project is music.
There are a lot of examples of use, the main thing is to comply with the terms of use.
