Styles rejected, says too similar, item is over 5 years old

I just had a plethora of photoshop text effects / styles rejected and the message I received was:

“Unfortunately, your submission is too similar to existing item(s) in our marketplace. Your upload must be a unique concept not based on any existing marketplace item.”

Just funny considering these styles are more than 5 years old that I did when I was working at the agency. Now I’ve been looking around the photoshop style section and I’m finding a lot of people that have copied styles that I had on my deviantart account under my portfolio that have never been uploaded here. Luckily, I’ve just gone through my portfolio sites and removed all of my graphic design work, hoping that no more of my artwork is stolen and uploaded here.

I find it odd that they say my styles are too similar to other items on the marketplace, when in fact, others are taking my styles, mimicing them and uploading them as their own. So now why is it that I have to suffer by uploading unique styles that others have copied off of my deviantart portfolio? I have a list that I can show but I believe posting to other items is against forum policy.

This really strikes me odd that the reviewers are willing to allow uploaded materials of items that were stolen from other places outside of this marketplace and then when you upload your items that have been sitting around the internet, they say they are too similar… only reason they are similar is because other authors are styling our styles!

SOMETHING NEEDS TO BE DONE HERE !

Umm yeah if you are the creator of the styles and they are old work of yours how hard can it be to make them better thinking that you improved from the time when you maked your styles…and your problem is one of those problems where you need prof that the styles are yours and prof that others copyed them exactly from you ….but yeah,I understand you problem :( , an other angle to see this is that they copyed your shity old styles cuz you have even more better ones now ,but that is just me. :) Well I’m shure you will find an way to solve this problem.

Yea, it’s ridiculous. I’m waiting for support to give me a list of styles that they say look similar, can’t wait because I’ve already contacted my trademark Attorney W. Noonan and I’m going to have him write up a letter that we can send out to each other that is included in the list that they provide, that’s if they even provide a list.

That’s just the thing though, I gave away so many free style templates in the passed through deviantart art, vectoreezy, bursheezy, etc… that now I have to suffer because these new authors come in here, take my hardwork and refurbish the design as their own and they do nothing about it around here.

Well of course the styles going to look the same as mine, when all these guys do is download / purchase top selling items / free items, change a few things / textures and call it their own. Hell even one of the new styles put up is using the same damn custom bevel that I created in my free pack I gave away on my DeviantArt account.

Just an FYI , I created a journal letting everyone know that I have removed all of my free files online, just waiting on a few more sites to respond back letting me know my art has been taken down from their servers. All it takes is 1 bad apple to ruin the bunch, so no more freebie’s from this guy.

Reviewers need to take a look at the name of textures, gradients, and custom bevels to make sure they are not taken from other files… it’s apparent most of them don’t even rename the shit they take from other sources and use as their own.

Here’s another set that I had given away on DeviantArt for 5 years straight.

Go browse styles and you will see a ton of people using the same styling as these. This is just ridiculous.

if you think, that someone simply had taken your stuff and uploaded it here to GR, why not to send DMCA to Envato.

If you can proof it, there shouldn’t be any problem, especially that you have sources

Forgive my lack of knowledge of DMCA but wouldn’t the copyright holder need to have a copyright on it in the first place?

Sending DMCA notice act is a waste of time, the authors don’t even provide a real email address and don’t display a country flag. I emailed 2 of the authors, no replies nothing… it’s a damn shame you can create an account, change your email to a non valid email address, and just ride freely with the money coming in from people hard work.

DMCA notice act don’t do nothing, you can send the notice, and then rebutle and then it’s up to you as the author to take legal action… really, you gonna drop a $2500 retainer fee on a lawyer to try and get your files taken down and not even be able to get damages? IT’S WORTHLESS !!! BEEN DOWN THAT ROAD WAY TOO MANY TIMES !

If you want my opinion on the deal, staff here just too lazy to investigate items themselves, so they wanna pass the buck back to the author, whom they are taking a large percentage of money from and expect us to do all the hard work. Aint no updates going on with the site, you got customers on photodune posting in the forums talking about they leaving because the site is just lacluster and confusing…. really ridiculous stuff.

oh and regarding my post, you can see how old these are because I didn’t even change the background image out from the original file LOL I told my wife that was the first thing I was gonna do… i guess i forgot lol I’ll probably change out the background image tomorrow or something and get these ready to go on my CM shop.

I feel you. The reason stated “Unfortunately, your submission is too similar to existing item(s) in our marketplace. Your upload must be a unique concept not based on any existing marketplace item.” is really a pain. I got it once even though the idea is my own and there is nothing such as “based on any existing marketplace item”. Of course I did contact Support after that – yeah I don’t want to start a war with them on which is “similar”, which is not and so on, just to say: I did not do it based on any other’s works, don’t tell me so. But soon you would realize that when Support reach your ticket (1 week after now – if they ever reply), things are already changed. Of course I moved on with my other projects and the feeling was not the same anymore.

Many people are fighting out there, with the only weapon so-called “DMCA”. I don’t know what to tell you now, just calm down and do what you feel alright… Best wishes.
