I also have some questions:
1. What happens with all of those themes who have external plugins in them? Are those themes ok because the items included are based on the previous license, even if the source files are still included?
2. What happens if i’ve bought an extended license prior to the changes, which i didn’t use. Could i still embed the source code in my files?
3. It is impossible to create a theme and don’t embed the source code of the plugin you’re using. So if you want TF authors to use CC items, this line must be gone..
4. If you require us authors to make private partnerships with CC authors, then the partnership is my business, right? You aren’t enforcing any kind of partnership so if i an autor agrees on a fixed price for an extended item, that’s my business with him.. Like Jack said, there is absolutely no way for a TF author to still use a CC item without breaking the new rules.. So?

Collis has an answer for that on page 3: http://graphicriver.net/forums/thread/new-marketplace-license-discussion/85239?page=3
That’s not an answer
Because with the expression “informal arrangements”, Collis allows us to do whatever we want behind Envato’s back.

Sorry if I haven’t been as clear as I need to be. Hopefully I’ll be able to answer better this one last time. After that, for these specific questions, I’ll just refer back to previous posts.
Theme authors can’t just purchase an extended license of a CodeCanyon (or whatever, this is just the pertinent example) item and use that item in their theme. Our licenses no longer allow that. If they’d like to team up (the theme author and the CodeCanyon author), they can, but not through Envato. They must do it on their own. We may add a new license for this in the future, but not at this time. If the CodeCanyon author is exclusive, they can’t just sell the item to the theme author. Instead they’d need to team up. Since the agreement is between the two authors, not Envato, that’s something they’d need to work out among themselves. As this is an agreement between 2 authors, not with Envato, the reviewers can’t check it. If the CodeCanyon author sees that someone is using their file improperly, they can tell us and we’ll pull it down.
That’s the rule. If you’d like to read the reasoning, please see Collis’ post on page 3: http://graphicriver.net/forums/thread/new-marketplace-license-discussion/85239?page=3
Hopefully that clears it up. If you are still unclear of how this rule works, please feel free to private message me and I’ll do my best to help you understand.

Thanks for your answer Lance.. So as i understand it(just to make sure i’m clear), it is my business and not Envato’s to make(or how do i make) the deal with the other author..
Please address my point no #3.. What about the source code in this case?
And point #1 .. What about all the files that include other files based on the old license?

Hey Reuben, both have been answered several times so I’ll just refer you back to previous posts. If you have more questions on this same point, please feel free to pm me.
so, just to clear this out:
New licences do not allow themes authors to buy product on Codecanyon and include it in their themes on ThemeForest(for further sale), and on the other side authors at codecanyon can not sell those same product outside the envato marketplaces because in that case they will lose “Exclusivity of their Items” which is equal to loosing money because they will lose % of each sale.
If i am right, isnt this something you should discuss with authors before making these license changes?
And i have few questions: 1. if CC author makes an partnership agreement with TF author outside envato marketpalces, is CC author going to loose “Exclusivity of Items” 2. if 1st statement is correct, is there any possible solution for this, i mean is there a legal way(by envato) to include CC product in Theme for further sale?

Yes, but those answers are not exactly related to questions I and Ruben asked. If they however apply also to themes, then you need to wipe out 70% of WordPress themes from TF

1. if CC author makes an partnership agreement with TF author outside envato marketpalces, is CC author going to loose “Exclusivity of Items”
good point. as exclusive authors we are not allowed to sell the items in any way except the marketplace system.
You can’t sell items outside the way the marketplace works.
Actually, there have been examples in past when authors asked if they can sell an item directly to their client and staff answer was “you need to buy the item from the marketplace on behalf of the client”
so this quote from collis post is misleading (if not clearly wrong) till the exclusive author/envato agreement will be changed to reflect this new type of behavior:
“If you’re an author and want to use another author’s item in your larger stock item (as part of the download) it is still possible to make your own informal direct arrangements with the other author.”
please note that the text above doesn’t mention if you are allowed to make a private agreement between authors of this marketplace or you can allow the use in another stock item sold on a marketplace outside the envato network.
I’m just happy multi-use licence is into discussion.
