I was reading the WIKI and searched through posts here on AJ and still don’t understand several aspects of licensing. Maybe I’m a bit slow minded ![]()
Everything started when a possible client asked me what license he needs to buy for a Flash game (aka browser game).
I’m pretty much sure that he needs an extended license but I thought to ask here.
Also, what difference makes if:
- He sales the game to a bigger company (as he, small developer, resell the game using my music)
- He don’t sale but get sponsored (and put all those clickable annoying ads on loading screen).
- Has been a member for 2-3 years
- Contributed a Tutorial to a Tuts+ Site
- Author was Featured
- Sold between 1 000 and 5 000 dollars
- Bought between 1 and 9 items
- Norway
- Has been a member for 2-3 years

Look guys, I’m not the only one finding the license confusing.

There are some more people, including my buyers that find it confusing. Please someone from “officials” answer it, so I can send a link to this thread to the game developers.

Hey Mihai,
For a commercial game that is sold / costs to play, the customer needs the Extended license. For a “free” game, a Flash game that is embedded on a Web site for example that does not cost to purchase/play, the regular license is sufficient. Hope this helps.

How about if the game is sponsored ? As the developer sell the rights to bigger companies or run adds ?

Theres been 1 or 2 comments/threads in the past on FGL regarding AudioJungle’s license when it comes to flash games and the staff/members didn’t seem to have a straight answer or in the case of FGL games seemed confused on how sponsorship affected their ToS. JHill’s description ‘convoluted’ sounds about right. Would be interested in the reply too Mihai.

Multiple points of Audio Jungle’s licensing terms point to the Extended License for flash games. Many developers have confided to me that they have just used the personal license which is terrible practice. Musicians should be paid fairly for their work just like you expect to.

The problem is with AJ though. They have to write their licenses to encompass every known use of audio under the sun so it’s best to be vague and use graphics and brochures as examples for their audio license. What they should have is a set license for particular uses.. but good luck with that. A little clarification would go a long way though.
this was about this part of license:
(h) If the Work is used or incorporated in a work there is no restriction on the number of copies of that work that can be reproduced and distributed (provided the use/incorporation remains a single application and the copies are not for Resale).
For example, you may incorporate the Work, such as a graphic, in a brochure you design for your client. An unlimited number of copies of the brochure incorporating the Work may be made but the Work cannot be incorporated in any other application. The brochures must be distributed to recipients at no charge to the recipient.
Thought that a feedback from the possible clients would be helpful.

I agree that there’s definitely some improvements we can make as we move forward.
I am a bit confused by some of the comments though that are referring to wanting specific examples + quoting “brochures” and “design” because we have a full page in the wiki that gives specific audio licensing examples and we do not mention “brochures” or “design”. Maybe the following link will help those customers?

Well, they don’t contact support, they contact me
because I’m the one selling the track.
So, this new link is more clear, but still lets out the games. There are countless internet pages that have flash/ browser games. All of those games have music and sound effects. Yet, in the license of AJ there is so poorly covered.
According to those Licensing Terms should be fine for a Flash game to get the “Regular” license.
According to this page, a flash game should have a extended license.
Anyway, why a heck on the songs on AJ, near the button to buy track you have explanation about brochures and printing ?
Also, sincerely, you as a customer, what would you do, buy a track for 12$ instead of 70$ or go contact the support and clarify the licensing and get the track for 70$ ?
And why am I the only one concerned about this ? Aren’t others sell for computer games ?
Sorry if my tone is a bit harsh, I don’t mean it, but knowing that someone pay 12$ from which I get 3$ for music in a game that should cost around 100$ it’s bothering me.

i DO AGREE WITH YOU THOSE GUYS WHO USES THE AJ TRACKS FOR GAMING WHETHER ITS FOR COMMERCIAL USE OR ANY OTHER USE THEY SHOULD GET THE EXTENDED LICENSE . AS ITS BEING USED MULTIPLE TIMES . APART FROM THAT IF U BECOME THE EXCLUSIVE AUTHOR YOU WILL GET 50 % OF THAT AMOUNT . AS I FEEL U R LOOSING MORE CASH FOR NOT BEING A EXCLUSIVE AUTHOR NOT FROM AJ BUT FROM OTHER MARKETPLACES AS WELL . I took a look and none of the licenses cover the free online games. Most of them are free for playing but got sponsored (starting from 1000$ and that I know from a game developer) to run adds, so please make something to cover that issue.

Mihai / Dan, you mentioned that you’re seeing “brochures” and “printing” on the AJ item page, do you mean in the area below? If so, that should not be happening because as per the screenshot below, I’m seeing only audio-related information. If I’ve misunderstood however, please let me know which page and which section you are referring to so we can investigate further, thanks a bunch!
