Also a dmca is not needed as Envato has the rights to remove any item without notice or reason, so why a dmca is needed is beyond me :/
I am glad that his item has finally been taken down and his account has also been disabled, but I hope a stolen item won’t stay in the marketplace for that long before it is removed when there is sufficient evidence.
If there is not enough staff, I don’t think it would be a problem for Envato to hire one or two new staff to handle the Support problems since there is a recent increase in price for the items, as well as increased overall sales in the marketplace.

There is some really great discussion here and I just want to chime in real quick to say that the support team does have a process for dealing with reports involving copyright or intellectual property claims the outcome of which can range from file disablement or all the way up to permanent account bans. In many cases, it’s more complicated than simply pulling the plug on an entire account without speaking with the appropriate staff and having a thorough investigation/discussion about the specific case. I suspect that may be the situation here.
With that being said, I want to stress that Envato takes copyright and other intellectual property issues very seriously. Every copyright/IP concern sent to the support team is responded to and I encourage you to contact us immediately if you have a concern about a file or author.
@bitfade If you haven’t already, please contact us about the issue that you’re talking about in this thread. If you’ve already submitted a ticket, please let myself or Travis know the ticket ID number so that we can follow up on it.

We all understand that a user who violates the copyright agreement will have a item removed and possibly have his/her/their account disabled, but when its a blatant rip like a lot are becoming and found guilty for, then the author should be disabled out right and not just item removed!

I’ve been able to follow up on the specific case in discussion here and the report was received by the support staff on Sunday (yesterday). The file in question was immediately disabled at that time and assigned to a Senior Reviewer to confirm the complaint. As it was the weekend, these things may take a little longer than 24 hours to be processed. The information we receive back from the reviewer will then allow us to consider our next steps.
I want to stress that it will be fully investigated and handled appropriately but, to echo what Travis and myself have already said, these cases often require more than one staff member to process and can at times be complicated, but they are not taken lightly.

Is obvious that support will request for a DMCA when someone will just ask them to investigate some claims. They ask for the DMCA because they have no instruments and authority to investigate that issue except complying with a takedown request as required by law.

My issue was ignored at the time I made it. Hopefully things are getting better.

I had a similer issue 3-4 weeks ago and nothing happened to the author. I sent 3 support tickets and all i got back was because of privacy reasons you could not say anything about the author who violated my rights.
There has also been a few more, 1 author saw a thread on here and took his item down and came on and admitted he stole from an author on here only a few days ago.

However, dealing with this particular case wasn’t the only reason why i opened the thread. I can understand a DMCA is mandatory when dealing with copyrights holders outside the marketplaces but not when both original item and copycat are sold here.
As other author pointed out, according to your terms, you can remove any item any time at your sole discretion. Stop answering “We cannot do anything unless a DMCA is filed”. You can. Do it.
Support staff needs to be increased – and weekend support staff need to be added. This marketplace is to large to have such slow response time…. just my observation

Just an observation (maybe a bit offtopic) : There is not such thing as “weekend” on the Internet. Internet is alive, awake and vibrant 24/7. So should be a company which bases it’s activities 100% on the Internet…
