The only restriction concerns templates and software applications :
if the Work is a template or software application you can’t sell it as a tool, template, stock item, or have the source files included.
It doesn’t say anything about music, so according to these terms one can use AJ music in video templates.

Hmm. I always thought “the Work” referred to the larger work but looks like i’m wrong. In that case, there’s nothing preventing VH authors to include AJ music in their projects with extended license.

"The larger project is usually not a template or stock item." In this sentence, i don't like the word "usually". It's open to interpretation. After all, the actual license agreement might be more binding then this explanation.

The 3 cases where exceptions take place are explained further in the original post.

Exactly. It’s very strange that the only mention of this important info can be found only in some god-forsaken post. It’s something that should’ve been a part of the license.

Just inform:

My question to support :
Hi, I would like more informations about the extended license use on Audiojungle. It says : “Using an item as a small element of a larger project: A sound effect from AudioJungle could be used in an After Effects project for sale.” Does that works for a music too? Can I purchase an extended license and sell my after effects project and include that music in the project file on marketplaces? Thanks! Florian
Envato reply :
Hey Florian, The same rules apply to music as the sound effects in this situation. http://support.envato.com/index.php?/Live/Knowledgebase/Article/View/393/70/audiojungle-license-usage-examples http://notes.envato.com/general/extended-license-changes-part-1/ Kind Regards, Curt Z.
We are allowed to do that.

I think it is not smart for VH authors to buy an extended license for $70, and what if the buyer wants another music? So, VH author spended $70, but music is not usable.
But, of course, besides this, I think that we all (aj, vh, envato, buyers) win from the situation where VH authors just use the mp3 preview.

I agree, it doesn’t always make sense to do so since a buyer may have their own music in mind. However if a VH author gets, say, only 10 extra sales by including the music, that already more than pays back the measly $70 upfront cost. Imagine a VH author included one of your awesome and popular tracks with their template? I bet there’s at least 10 customers out there that would love to use your music with that project (particularly if the animation is meticulously and well crafted to that specific track), and would be more than happy to get your music track included for no extra cost.

If there was a choice between a $15-$20 template that didn’t include music and one that did, especially when getting the music separately would just about double the item cost from a customer perspective, I think it’s safe to assume the VH template with music will benefit from additional sales. And easily more than just 10 extra sales, particularly if it’s a popular music track. Would you really be alright with your music being resold 100+ times without you seeing another dime? That’s $70 vs. $700+ dollars.

I agree that simply using the preview track is win-win for everyone. I honestly don’t think too many VH authors engage in the extended license practice, as many of them get how potentially abusive it is and prefer the collaborative approach and mutual promotion. But clearly there are those out there who are looking to take advantage of these licensing terms.

DOGmotion, just flagged for stuff reply, all good with your post :)

BUT

we need to have an official staff statement about this issue ASAP . If this answer you mention is the serious view of Envato (that an extended music buy means you are allowed to sell it with a VH project) then I have been a member of this marketplace for the longest time. This is just ridiculous. Apart from the fact that this answer is contrary to the license terms.

Please somebody tell me that this is NOT Envatos policy!

+1000.

I’ve also had to disable extended license sales on my goods, out of principle – until we get a solid answer on this.

+1 trillion squillion. Also disabled extended licence sales until this is sorted, it’s very disconcerting to think this could be done with our tracks with Envato’s blessing.

Okay, so regarding by this official statement by staff on videohive regarding the license changes: http://videohive.net/forums/thread/extended-license-changes-part-2/65723?page=4#583501 I’m off AJ immediately.

Sad, but this policy fails the value of musical art throughout!
