According to this sites copyright policy we can not upload another authors file and resell it on FlashDen to buyers. But what about those who are reselling authors files through direct contact with a FlashDen buyer, either selling the original file lower to it’s original price or selling it as a modified version at a higher price. Surely this a copyright breach if one author is selling another authors files to the same FlashDen buyers? Hopefully staff could clarify on this because this seems to be a bit of a grey area.
But then custom work to another authors file would be illegal, since you are reselling the file in a modified form to buyers on the same marketplace – but it seems to be allowed.
Also I had someone contacted me recently saying they had purchased my file from someone else at a discount and was trying to get support through me, but without a purchase history I won’t support them. So there is obviously some reselling of files happing through direct contact with buyers. I guess I notice it more often because I sell more so more chance of it happening to my files.
Well, I wouldn’t be surprised that this kind of things happens… but it would be very hard to stop these “natural” mechanisms…
...I think it’s all about persons… buyers should be fair and always buy from flashden and authors should always sell through flashden…. for example one time I’ve got an email from a person that wanted to buy one of my files directly from me at a lower price… I didn’t even answer to that email, we have an agreement and I don’t want to break it for few bucks… but again it’s all about how fair people are…
Well, custom work to another’s file is not considered illegal because when one purchases the file for use in a project for another. That buyer is purchasing that file for the intended client. Meaning the client owns the file not the buyer.
But in this case its tricky because the client is contacting you, and not the buyer. I don’t think you have any reason to worry, to me it seems like 1 of 2 possible things.
1. Its a legitimate person who is having a problem with a file that someone they paid, bought for them. In this case you should tell them to defer the question to the designer they paid to make the site in question, and then that person can log in and ask you. If I design a website for a client, and the host goes down…my client does not call the host directly. He/she calls me, and I call the host.
2. This person may have gotten their hands on a not-so-honest copy of your file, and after being called out on not buying the file. The reaction response was “someone bought it for me”.

I got one once saying they wanted to pay me more than it was for sale for, just seems fishy to me, not to mention I’m exclusive so I can’t. I didn’t respond either.
