Answer is yes, and better if you can have it approved as PSD first, this really increases the chances for being submitted as WP. And it’s up to you to include PSDs with HTML or WP versions, however I’d recommend doing so at least for the main elements, buyers like it.
Bogdan, I’d definitely contact support asking for further clarifications regarding rejection.
Perhaps you have some server-side limitations regarding upload file size. Try to upload via FTP . Also make sure you have necessary permissions set.

Please stop accusing me. Whether I have violated a copyright or not is subjective to one’s own judgement and perception. Just that I have not filed a counter DMCA in order to avoid delays and in hope to find a negotiable way out, does not make me an accused.
I don’t think that repeating the same thing 100 times will make anyone feel better. Sorry man, but i don’t find your attitude friendly at all. The person is in bad situation and if you can’t help him, feel free to keep your opinion to yourself, this is sometimes the best decision. How would you like it if you were in his place and someone treated you the same manner as you do? Trying to be more tolerant has never hurt anyone.

This happens when you try to uploaded the downloaded package directly. You should unzip it first and choose only the theme’s core files as the package also includes the license, documentation, etc… Generally this is a zip file called THEME _NAME.zip
