this is not useless, people not familiar with this marketplace may assume certain things that are not. It is positive to debate this issues so everything gets clear for everybody.

I have a lot of years sticking around here and I still find certain rules that I didn’t knew about.

The notice you get after purchase about the files getting removed doesn’t look so important. If the file is removed you don’t get informed one day before, actually you never get informed and you may still think the files are there, till you need them and you head up to your download area.

Then surprise, no more files. Imagine the frustration. You can blame yourself but let’s be honest no one blame themselves for missing to understand the importance of a notice when you purchased the item.

Never downloading the item is an extreme case but what if you want to access the source files for some project you made months or years ago? Maybe you misplaced the files or the hard drive crashed. You think the files are there but when you check the files are gone.

This should be improved, how the buyer are informed, how the items are removed, everything.

Doru the fact that the disclaimer you mention is posted there is so far from a direct and/or specific disclaimer it would hold NO WEIGHT in an actual court of law. I only bring this up because if your basis here to defend envato here is on that disclaimer this is no legal or moral ground to stand on.

Not defending envato :) just pointing out how the marketplace works else we will just discussing on affirmations that are not true. If I’m showing the rules doesn’t means I’m ok with them.

Actually I think the files should be available for download for a limited period of time and then they should be removed from the download area. But this is my opinion, have nothing to do with how the website works.

For the court of law it matters the legal agreement you accepted when you made an account here. That bids you to the rules and you can’t win this particular issue in any trial.

But anyway this is not the point here, you did ok to point out the issue you have and hopefully the staff will see it and maybe they will try to improve the buyers user experience.

As I said the staff can’t force authors to keep the files online but I believe many of us will do it if the system could allow it.

The buyer has every right to download the item he/she has paid for regardless of whether the author or envato has removed it.

Let’s not jump to conclusions and give a wrong idea about this.

When a buyer purchase an item he can download it immediately from his account.

If the buyer, for different reasons, doesn’t download the item five days after purchase and the item is removed, then he will receive his money back after contacting support.

If the buyer ignores the warning that the items “may get removed, please download it immediately” then is not the fault of envato or the author, but is the buyer fault. We can’t sugar down this. If you don’t download it during six months and then it get removed bad luck. You should be more careful next time.

We should treat everyone as adults that knows what they are doing.

Said this, envato needs to make more clear the nature of their service and the reasons why items get removed but statistical there will always been someone who didn’t understand correctly what is the nature of the service provided here.

The analogy with steam is correct till a certain point. Steam sell individual game licenses to their users, with no possibility to use them commercial and also offer a free storage space for your games, BUT they also can remove your games from the library at any time exactly as envato.

The difference is that they advertise the storage and availability of their products and envato clearly say the items will get removed at any time. Steam hides this in their terms of service that no one reads.

Legally envato can ask authors if the item they want to remove can be keep on their servers for who bought them. Should be made as an option for each item when you click on the delete button.

I have some items that don’t sell anymore and I keep them online just maybe someone needs them. If envato want to keep them in the download area I will be happy to give permission to do it.

there some misunderstandings, envato is not a storage service, so they can’t guarantee you that the file will be downloaded in six months from now. And since the owner of the file is exclusively the author he can remove the item, for various reasons, at any moment.

So is best to always download the item after purchase.

If you purchased the item in the last five days and you never downloaded the item you can contact support and ask for refund.

Again, very important. envato is not a library based system (similar to Steam) They just offers you to download the items at later times but is just a courtesy not an obligation. As long the item is on the marketplace you can download it but if is removed then envato can’t legally provide you with that file since they not own it
