You mentioned this a couple of times already, but if you think it through, you might realize that this is not going to happen. This is not a case of a well-known brand like Apple – where everybody recognizes its products through logo and design in a second – and a blatant no-name wallmart copy of an iPod. There are simply two themes that look alike, the buyers won’t care because you (no harm intended!) are not a well-known brand.

If buyers would compare the two themes they won’t even realize which one was there first unless they check the date or this thread – and even then they won’t care, they buy what they like without moral conflicts (and most will buy yours because it’s better looking, has more sales, probably better rating and easier accessible since you said it’s in the top files.)

Other than that, I see the similarities and I strongly advise talking to the author himself, because I think that DMCA, let alone court will not help you in a timely manner; however I would still prefer DMCA.

No, I don’t know the author and I have never heard of you as well. Objective opinions given.

Theme Hospital. I got it about fifteen years ago (or whenever it came out) and I keep going back to it. Love everything about it!

Aw I’m playing that too currently, so glad they made a Mac hack ^^

I’m also playing Playboy – The Mansion and I must say I really fancy this life :D

I didn’t meant a detailed feedback… A simple “Change the typography, add more contrast, i don’t like the sidebar at all and the footer is too big” is all I ask for, but I don’t even get that.

I understand, but isn’t that what you usually get upon request?


After sending a support ticket asking for specific reasons of why my theme was rejected, I got back a “Your item is not unique, we already have plenty of those. Ask on the forums.” – so, for me, sending a support ticket won’t help you at all. (i’m speaking from my experience, of course)

In the case of uniqueness to be frank there is not even more to say than “it’s not unique”. They cannot advise to add another slider, make it 5 boxes instead of 3 or similar… if it’s not unique you will have to come up with something new. There are millions of possibilities in which way you can change your theme if it’s “just” not unique, so having concrete feedback here would basically mean they are not suggesting improvements, they are suggesting the whole look and feel of the theme. And this IMHO is too much of a feedback, because it’s your work and not a cooperation.

Every big company on earth has started somewhere, made probably miserable products, then learned, got “rejected” by society, improved, improved, improved until they got “accepted” by society and sold. You just cannot expect others to tell you exactly what to do. It’s feedback, not cooperative work.




Can you imagin authors giving generic answers for support :) How many stars would i get?... gues would have to make red angry smiles to cover the frustration :)

The difference here is the following:

Authors giving generic support: Who is responsible for the theme looking good, the code being perfect and the features working properly? – the author.

Reviewers giving generic feedback: Who is responsible for the theme looking good, the code being perfect and the features working properly? – the author.

Do you see what I am trying to say?

Hi, I am not available but I just wanted to pop in and quickly advise to check your spelling, grammar and punctuation. I had to read your sentence twice to know what you’re talking about.
Also, your profile image and even the PSD files have so many errors in it… it comes across pretty unprofessional. Maybe you want to get somebody to check your text before you send it live :)

Edit: Thanks for the email but I don’t need an explanation :) It’s your decision in the end; I thought you might want to have a thought about that… I just feel it’s contraproductive to upload a profile image and not even take the time to check for spelling, grammar and punctuation. Maybe people will think your way of working is as faulty and full of errors and lazy mistakes as your language skills :)

Editedit: and oh, oh – fun fact: you say “i think this is a design market place and not a language university” – yes, and Ferrari only builds cars, but if their advertisement is full of errors they’re going to have a bad time ;)

I don’t understand: You want somebody to send you money that you will send back later? Or do you mean donations? I don’t know if it will work, just some weeks ago the most active buyer here asked for donations for his sick dog – he disappeared afterwards. :/
Can you ask somebody you know personally so the danger of being ripped off is lower? In the end, if you don’t pay, there’s nothing we can do.
